Short answer: No, you can’t drive alone with a permit in California, at any age. If you’re under 18, a parent or guardian, a California-licensed driver 25 or older, or a certified driving instructor must be with you. If you’re 18 or older, you need a California-licensed driver who is at least 18. Either way, that person must sit close enough to take control of the car.

Can you drive alone with a permit in California?
No. The DMV is blunt about it: an instruction permit “does not allow you to drive alone at any time—not even to a DMV office to take the driving test.” That last part catches people. On test day, a licensed driver has to bring you to the DMV.
Who must be in the car with you
| Under 18 | 18 and older | |
|---|---|---|
| Who can supervise | A licensed parent or guardian, a California-licensed driver 25 or older, or a certified driving instructor | A California-licensed driver 18 or older |
| Where they sit | Close enough to take control of the vehicle if needed | Close enough to take control of the vehicle if needed |
| License they need | A valid driver’s license | A valid California driver’s license |
For teens, the 50 practice hours the DMV requires must be with a California-licensed driver who is at least 25. An older sibling who is 22 doesn’t qualify, even with a license, unless they’re also a certified instructor.
Teens: your permit isn’t valid on day one
If you’re under 18, you can’t use your permit the day you get it. The DMV says your instruction permit becomes valid after your professional driving instructor signs it, once you’ve completed at least one hour of behind-the-wheel driver training. Before that signature, don’t practice with anyone, even a parent.
The DMV lists this validation step under the requirements for applicants under 18. Adults practice with a licensed supervisor 18 or older under the adult rules.
Where and when can you drive with a permit?
The DMV’s permit rules focus on who is in the car, not on roads or times. The DMV pages we reviewed don’t list a curfew or a ban on certain roads (such as freeways) for permit holders. The 11 p.m. to 5 a.m. limit you may have heard about applies to teens with a provisional license, not to the permit.
A few rules still apply every time you drive:
- No phone if you’re under 18. California law bars drivers under 18 from using a cell phone or wireless device while driving, even hands-free, except to call emergency services or on private property.
- Insurance in the car. The DMV says proof of financial responsibility must always be carried in the vehicle. When a parent or guardian signs a minor’s application, they accept financial responsibility for that minor.
- All the usual traffic laws. Speed limits, seat belts and right-of-way rules apply to you exactly as they do to licensed drivers.
Common sense matters too. Start in empty parking lots and quiet streets, then work up to busier roads, night driving and freeways as your supervisor thinks you’re ready. Teens need at least 10 of their practice hours at night, so plan for that.
How long you must hold a permit
If you’re under 18
You must hold your permit for at least six months (or until you turn 18) before you can schedule the drive test. During that time you also need:
- 50 hours of supervised practice, including 10 at night.
- At least six hours of behind-the-wheel training with a professional instructor.
- Your parent or guardian and your instructor to sign off on your practice.
The DMV offers a Supervised Driving Log to track your hours.
If you’re 18 or older
The DMV’s pages don’t state a minimum time an adult must hold a permit before the drive test. Practice until you feel ready, then schedule it. Bring a licensed driver who is at least 18 to the appointment.
How long a permit lasts
Your application and fee are valid for 12 months after you apply. If your application runs out before you’ve held the permit for the required six months, you’ll need to reapply at a DMV office. The DMV gives you credit for the time you held the expired permit, so you don’t start the six months over. Bring both the expired permit and the new one to your drive test.
Adult vs. minor permit: the key differences
| Rule | Under 18 | 18 and older |
|---|---|---|
| Minimum age | 15½ | 18 |
| Driver education to apply | Yes, until 17½ | No |
| Parent or guardian signature | Yes | No |
| Valid on day one | No, needs instructor signature | Yes |
| Supervisor age | 25+ (or parent, guardian, instructor) | 18+ |
| Minimum time before drive test | 6 months (or until 18) | Not stated by DMV |
| Required practice hours | 50, including 10 at night | Not stated by DMV |
